When you make your Social Security Disability Income application, the SSA will
advise you as to whether you have sufficient work credit to be eligible for SSDI. If you
do not meet the employment history eligibility requirements, you may still qualify for SSI.
(See the Supplemental. Security Income section.)
The procedure for applying for Social Security Disability Income can be confusing. Your
lawyer can help you understand the process better and prepare your application to give
you the best chance of success.
In the event that you initial application is denied, which happens in almost 70% of
cases, you are entitled to appeal through several levels to have your claim approved.
The assistance of an attorney in the appeal process is of great value.
We will help you with numerous essential steps in the process, such as:
Time is important. If you wait too long to apply or to file a Request For Hearing to
appeal, under the law you may lose your entitlement to some or all of your benefits. Call
us today to arrange a free consultation with a lawyer, without obligation.
- Proper form completion and submission for your Request For Hearing and all
appeals.
- Contact your medical providers to obtain important records and customized
reports.
- Arrange for medical or vocational examinations, if necessary.
- Prepare you and any important witnesses for testimony at all hearings.
- Represent you at all hearings and assist you in testifying and presenting
evidence and witnesses. Also cross-examine SSA's expert witnesses.
- Attempt to reopen any old application for benefits that you may have filed to try
to maximize your benefits.
Regular Income: An SSDI award will provide you with regular monthly income,
roughly in the amount that you would receive if you received Social Security
retirement, with cost of living increase in most years.
Medicare benefits: Regardless of your age, 24 months after your SSDI payments
begin, you will be eligible for Medicare benefits, including Part A (hospital) and Part B
(medical). In addition, there are a number of other plans available to you that
supplement these benefits. In addition, you will be eligible for Part D ( Prescription
Drug benefits).
Dependent benefits: If you become eligible for SSDI benefits and you have a
dependents under age 18, they may be eligible for benefits.
Protection of SS Retirement: If you are on SSDI and reach retirement age, your
SSDI will end and retirment benefit begin. Being on SSDI up to when your retire will
prevent your retirment benefits from decreasing due to not paying into the system
while you are disabled.
Medical Insurance Extension under Cobra: If you receive a determination that
you are disabled by the Social Security Aministration and have recently lost your
medical insurance, it may be possible to further extend your COBRA beytond the
initial extension period.
Trial Work Period: If you begin receiving SSDI benefits and have an opportunity to
return to work, SSDI will continue to pay benefits to you while you attempt to become
reemployed. In effect, you will be receiving both SSDI benefit and your wages during
this trial period.
Social Security Disability Insurance (SSDI) is one of two separate income
maintenance programs run by the federal government and administered by the Social
Security Administration. The other is Supplemental Security Income (SSI). The law in
this area is complicated and the advice of an experienced social security disability
attorney can be crucial to your success in obtaining benefits.
To be eligible for Social Security Disability Insurance benefits (SSDI) you must have:
a. worked and paid into the program through payroll or self-employment
taxes in the required amount as follows:
- Younger than age 24 (worked 1.5 of the last 3 years prior to your disability
beginning)
- Age 24 - 31 (Your Age minus 21, divided by two) For example if you
became disabled at age 29, then you would have needed to work 4 years
from the time you turned 21 (29-21 / 2 = 4)
- Age 31 and older (worked 5 of the last 10 years prior to your disability
beginning)
b. have one or more physical or mental impairments that prevent you from
engaging in any substantial, gainful employment for at least one year.
Home,
